This document defines the rules for the processing of users' personal data collected by Swayfy, a company
providing hosting and authorization services through the website https://swayfy.xyz.

Scope and Purpose of Data Processing
User data is processed in order to conclude a contract between the user and the service provider, or to perform
a contract entered into at the time the user accepted the Terms of Service and deposited funds into the virtual
wallet, or when using our authorization API services.
The platform only processes the following personal data:
- Email address
- Username
- IP address
- Authentication tokens and session data
- API usage logs and statistics
Swayfy makes every effort to ensure the security of users' personal data and ensures that:
- All data is processed in accordance with applicable law;
- The purposes for which data is collected are clearly defined and lawful;
- Data is not further processed in a manner inconsistent with those purposes;
- Data is accurate, relevant to the purposes for which it is processed, and retained in a form that permits
identification no longer than necessary for those purposes.
Data Sharing
User data may be shared with third parties only in the following cases:
- If necessary to sign a contract or send correspondence, data may be shared with postal and courier service
providers;
- If electronic payment is used, we will share necessary data with the payment processing entity;
- User data may also be shared with legal, IT, and accounting service providers, or with third parties
involved in organizing training or educational events;
- When required by law or to protect our rights and the rights of our users.
User Rights
Each user has the right to:
- Access their personal data – including confirmation of whether it is being processed and how;
- Correct, update, or delete their personal data, or supplement it if incomplete;
- Transfer their data / restrict its processing;
- Object to the processing of personal data;
- Lodge a complaint with a supervisory authority if data processing violates applicable regulations.
Data Retention
User data is processed for the duration of the hosting service or API usage, and thereafter until any claims arising from
the agreement expire.
If the user has given consent for marketing communications, data will be processed until that consent is
withdrawn.
Authentication logs and API usage data are retained for security and operational purposes for a maximum of 12 months.
Security
We take reasonable measures to protect your personal information from unauthorized access, disclosure, or alteration. However, no method of transmission over the internet is entirely secure, and we cannot guarantee the absolute security of your data. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
Cookies
We utilize "cookies" to gather information. You can configure your browser settings to decline all cookies or notify you when a cookie is being sent. Nevertheless, if you opt not to accept cookies, certain parts of our Service may be inaccessible to you.
In the course of your site visit, specific information is recorded, typically anonymized and not disclosing your identity. However, if you are logged into your account, some of this information may be linked to your account.
Changes to the Privacy Policy
Swayfy reserves the right to modify or revise the Privacy Policy at any time without notice. Your continued use of the Service after any changes constitutes acceptance of the modified Privacy Policy. It is your responsibility to review the Privacy Policy periodically.
Terms of Service

The services offered via the Swayfy platform are provided by a natural person conducting non-registered business activity in accordance with Article 5(1) of the Polish Act of March 6, 2018 – Law on Entrepreneurs. The seller is not registered in the CEIDG and does not hold a tax identification number (NIP) or business registry number (REGON).
Definitions
Service Provider, Hosting – hereinafter referred to as Swayfy, offering hosting, authorization API, and related services.
Platform – the hosting platform Swayfy, including all its subpages and API endpoints.
Client – a user utilizing the services provided by the platform.
Server/Servers, Service/Services – virtual resources leased by the client through the platform, intended for specific tasks.
User Panel – the website used to manage the user's account and purchase services.
Server Panel – the website that allows management of the purchased server/service.
Wallet – a system that stores funds deposited into the user's account, used for service payments or purchases.
Subdomain – an additional domain through which the server can be accessed.
API – Application Programming Interface provided by Swayfy for authorization and other services.
API Key – A unique identifier used to authenticate requests to premium API services.
General Provisions
- The Swayfy platform offers virtual wallet top-ups, hosting services, and API services paid through deposited funds or obtained through support contact.
- By registering an account, the user agrees to these terms and conditions.
- If any rule is violated, the administration has the right to delete the user's account and/or purchased services without a refund.
- Appeals to administrative decisions can be submitted via the contact email provided on the website, within a maximum of 7 days.
- Individuals depositing money must follow the terms of third-party providers listed in the platform's privacy policy.
- Any actions that may harm Swayfy or its users are strictly prohibited.
- Users are responsible for securing their account, personal data, and service credentials.
Account Limitations and Usage
- Users are permitted to create only one account. Any attempt to create multiple accounts may result in the removal of additional accounts without notice.
- Users are strictly prohibited from sharing their account credentials with any third party. Accounts are intended solely for individual use, and sharing access with others constitutes a violation of these Terms of Service.
- Account suspension or termination may occur for violations of these terms, fraudulent activity, or misuse of services.
- Users must provide accurate and up-to-date information during registration and maintain the accuracy of their account information.
Registration
- To register, users must be at least 18 years old or have consent from a parent/legal guardian.
- Temporary or disposable email addresses are not allowed during registration.
- A user may only have one account on the platform.
- Login credentials must be kept confidential.
- For account deletion or data access, users must contact Swayfy via email at: support@swayfy.xyz.
API Services
- Swayfy provides free authorization API services for basic authentication needs.
- Premium API services with enhanced features and higher rate limits are available upon request. To obtain an API key for premium services, users must contact support at support@swayfy.xyz.
- API usage is subject to rate limiting and fair use policies to ensure service availability for all users.
- Users must not abuse API services, including but not limited to: excessive requests, attempting to circumvent rate limits, or using the API for illegal purposes.
- API keys are confidential and must not be shared with third parties. Users are responsible for the security of their API keys.
- Swayfy reserves the right to revoke API access for violations of these terms or misuse of services.
- API service availability is provided on a best-effort basis, and Swayfy does not guarantee 100% uptime.
Terms Modifications
- Swayfy reserves the right to modify or revise these Terms of Service at any time without notice. Your continued use of the Service after any changes constitutes acceptance of the modified Terms of Service. It is your responsibility to review the Terms of Service periodically.
- If a service was purchased before the change, the previous terms apply for 30 days after the update. After this period, users must accept the new terms to continue using the service.
- This change is in accordance with Article 8 of the Polish Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827).
- Login credentials must be kept confidential.
- Continued use of the platform after the service expiry date requires accepting the updated terms via the site interface.
Service Purchase
- A modern web browser and internet connection are required to use the service.
- Deposited wallet funds can only be used for service payments.
- Some payment methods may charge additional fees, which are displayed during checkout.
- Wallet funds are non-refundable.
- Servers include parameters like storage, RAM, SWAP memory, CPU share, IP address, and ports.
- Server validity is 30 calendar days.
- Users must pay for services regularly to maintain them.
- Users have 7 days to pay for a service. After this period, it is permanently deleted along with its data.
- Support reserves the right to deny assistance in cases of abusive language or disrespectful behavior.
- Server resources are shared with other clients.
- The provider strives to minimize performance issues related to resource sharing. Overcommitment of physical resources may occur, which is standard in hosting environments.
- VPS/VDS services include access to a virtual machine with an operating system, which the user can change.
Complaints and Cancellations
- Complaints regarding electronic services can be submitted via the email address listed on the platform.
- The complaint should include as many details as possible: issue type, date, contact info, server UUID, etc., to assist with processing.
- Complaints will be addressed within 14 days.
- Responses are sent to the user's email or another preferred contact method.
- In the case of complaints or 14-day withdrawal, funds are refunded to the hosting wallet. Hosting may deduct costs incurred during service provisioning.
- Wallet refunds are only available when no services are available for purchase.
- A service may be unavailable for up to 12 hours per month without prior notice.
- Service downtime caused by external factors (e.g. power outages, DDoS attacks) or maintenance does not count toward the above limit.
- Swayfy will make efforts to minimize planned downtime due to updates, hardware replacements, and other factors.
Service Usage
Services must be used only as intended, according to the name and category of the offer and applicable law. In particular, the following is strictly prohibited:
- Conducting attacks or security tests on computer systems, networks, or services of other clients.
- Port scanning.
- Distributing, storing, or processing illegal content, including leaked data, pornography, malware, etc.
- Sharing or using content in violation of licensing terms.
- Hosting gambling, phishing, or other illegal services.
- Mining cryptocurrencies.
- Excessive long-term use of CPU, disk, or bandwidth (by throughput or packets per second).
- Tunneling internet traffic, including running proxy/VPN servers or setting up other tunnels, without prior consent from the provider.
- Using API services for illegal purposes or in violation of third-party terms of service.
- Attempting to reverse engineer, decompile, or extract source code from our services.
Limitation of Liability
- Swayfy provides services on an "as is" and "as available" basis without warranties of any kind.
- We do not guarantee uninterrupted or error-free operation of our services.
- Our liability is limited to the amount paid for the specific service in question.
- We are not liable for any indirect, incidental, special, or consequential damages.
- Users are responsible for maintaining backups of their data and configurations.

Copyright Policy

1. Reporting Infringement
If you believe your work has been copied or used unfairly on Swayfy, please email us with the following information:
- Your name or pseudonym.
- Description of the copyrighted content.
- URL of the infringing material.
- Your contact information.
- A statement that you believe the use is unauthorized.
- Your signature (typed or scanned).
- A statement that the information provided is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

2. Counter Notice
If you believe content was taken down by mistake, send a counter notice with:
- Your signature (physical or electronic).
- Details of what was removed and where it appeared.
- Statement under penalty of perjury that you have the right to post the material.
- Your contact details.
- Consent to jurisdiction in your country's court system.
- Statement that you will accept service of process from the person who provided the original complaint.
3. Repeat Infringers
Accounts repeatedly posting infringing material may be suspended or terminated in accordance with our repeat infringer policy.
4. Good Faith
All copyright notices and counter-notices must be submitted in good faith. False claims may result in legal liability and account termination.
5. Legal Basis
This policy complies with global copyright norms including DMCA, EU Copyright Directive, and other applicable copyright laws.
6. Response Time
We will respond to valid copyright notices within 72 hours and take appropriate action, which may include removing or disabling access to allegedly infringing material.
